We operate the websites https://gardenconnect.app and https://my.gardenconnect.app (the "Site"), the mobile application Garden Connect (the "App"), as well as any other related products and services that refer or link to these legal terms (collectively, the "Services").

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation.

Industry Compliance:

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.). If your interactions would be subjected to such laws, you may not use the Services.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content").

The Content and Marks are protected by copyright and trademark laws and treaties worldwide. You are granted a non-exclusive, non-transferable, revocable licence to access the Services and download or print a copy of any portion of the Content solely for your personal, non-commercial use.

No part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, or transmitted for any commercial purpose without our express prior written permission.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username if we determine it is inappropriate or objectionable.

5. PURCHASES AND PAYMENT

You agree to provide current, complete, and accurate purchase and account information. All payments shall be in Euros. We reserve the right to refuse any order placed through the Services and to limit quantities purchased per person or household.

6. SUBSCRIPTIONS

Billing and Renewal

Your subscription will continue and automatically renew unless cancelled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge.

Cancellation

All purchases are non-refundable. You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term.

Fee Changes

We may make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:
  • •Systematically retrieve data to create a database without written permission
  • •Trick, defraud, or mislead us and other users
  • •Circumvent, disable, or interfere with security features
  • •Disparage or harm the Services or our reputation
  • •Use information to harass, abuse, or harm another person
  • •Upload viruses or malicious material
  • •Attempt to bypass security measures
  • •Use the Services for competitive or commercial purposes

8. USER GENERATED CONTRIBUTIONS

The Services does not currently offer users the ability to submit or post content. However, if this functionality is added in the future, any contributions you make must not be illegal, harassing, hateful, harmful, defamatory, obscene, bullying, or otherwise objectionable.

9. CONTRIBUTION LICENCE

If user-generated content functionality is enabled in the future, you grant us a perpetual, non-exclusive, royalty-free license to use, reproduce, and distribute your contributions.

10. MOBILE APPLICATION LICENCE

If you access the Services via the App, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on devices owned or controlled by you, strictly in accordance with these terms.

You shall not:

  • • Reverse engineer, disassemble, or decrypt the App
  • • Make modifications or create derivative works
  • • Use the App for revenue-generating purposes
  • • Create competing products or services using the App

11. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to other websites and content belonging to third parties. We are not responsible for third-party websites accessed through the Services or any third-party content posted, available, or installed from the Services.

If you decide to leave the Services and access third-party websites, you do so at your own risk. You should review the applicable terms and policies of any website you navigate to.

12. SERVICES MANAGEMENT

We reserve the right to monitor the Services for violations of these Legal Terms and to take appropriate legal action against violators. We also reserve the right to refuse, restrict, or disable access to any of your contributions and to remove files that are burdensome to our systems.

13. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy.

The Services are hosted in the United States and Belgium. If you access the Services from any other region with different data protection laws, your continued use of the Services means you consent to have your data transferred to and processed in these locations.

14. TERM AND TERMINATION

These Legal Terms shall remain in full force while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason or for no reason, including without limitation for breach of these Legal Terms.

WE MAY TERMINATE YOUR ACCOUNT AND ANY CONTENT WITHOUT WARNING IN OUR SOLE DISCRETION.

If we terminate your account, you are prohibited from registering a new account under any name.

15. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason without notice. We have no obligation to update any information on our Services.

We cannot guarantee the Services will be available at all times. We reserve the right to suspend, discontinue, or otherwise modify the Services without notice. You agree we have no liability for any loss caused by inability to access the Services.

16. GOVERNING LAW

These Legal Terms are governed by and interpreted following the laws of France. Both parties agree to submit to the non-exclusive jurisdiction of the courts of Béthune.

If your habitual residence is in the EU and you are a consumer, you possess the protection provided by obligatory provisions of the law in your country of residence.

17. DISPUTE RESOLUTION

The European Commission provides an online dispute resolution platform which you can access if you would like to bring disputes to our attention.

18. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

19. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO WARRANTIES ABOUT ACCURACY OR COMPLETENESS OF CONTENT.

20. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR DATA, ARISING FROM YOUR USE OF THE SERVICES.

Our liability is limited to the lesser of the amount you paid to us during the six (6) month period prior to the cause of action or 100.

21. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand arising out of your use of the Services, breach of these Legal Terms, or your violation of the rights of a third party.

22. USER DATA

We will maintain certain data that you transmit to the Services for managing performance. You are solely responsible for all data you transmit or relating to your activity. We shall have no liability for any loss or corruption of data.

23. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services and completing online forms constitute electronic communications. You consent to receive electronic communications via email and on the Services, which satisfy any legal requirement for written communication.

These Legal Terms constitute the entire agreement between you and us. Our failure to exercise any right shall not operate as a waiver. If any provision is determined unlawful, that provision is deemed severable and does not affect other provisions.

26. GARDENING ADVICE DISCLAIMER

The information and advice provided by Garden Connect are for informational and educational purposes only. While we strive for accuracy, gardening involves biological variables beyond our control (weather, soil quality, plant health).

Garden Connect shall not be held liable for the loss of plants, crops, or any property damage resulting from the application of advice. Users are encouraged to verify information and use their own judgment.
